Former day rate employee files overtime lawsuit against Applied Consultants

A former employee of Applied Consultants has filed a federal lawsuit against the company seeking unpaid overtime and other damages under the Fair Labor Standards Act, or FLSA.  The lawsuit was filed in the United States District Court in Midland, Texas, and is styled Sanchez v. Applied Consultants, Cause Number 7:15-cv-00162-HLH.

Applied Consultants is a pipeline inspection company that provides personnel and services to oilfield companies for all aspects of plant, pipeline, compressor, pump and metering facilities.  The plaintiff was employed by Applied Consultants as a pumper, and primarily worked in the Permian Basin, in the areas surrounding Midland, Texas.  While employed by Applied Consultants, the plaintiff alleges that he generally worked seven days one week and five days the next week.  The plaintiff alleges that instead of paying him overtime, Applied Consultants paid him a day rate, then a flat hourly rate for each hour the plaintiff worked above ten in a day.  As such, the plaintiff alleges that Applied Consultants denied him overtime for any and all hours worked in excess of 40 in a single work week.  The plaintiff seeks his unpaid overtime, an equal amount in liquidated damages, and his attorney’s fees.
