A construction worker in Fort Worth, Texas was seriously injured when he fell approximately 30 feet from the roof of the Kimbell Art Museum. According to a spokesman for the Fort Worth Fire Department said that the construction worker may have fallen through a sky light. This construction injury comes on the heels of another fatal construction accident at the Kimbell. In August, a construction worker was fatally injured after falling about 15 feet from a ladder onto his head at the Kimbell.
These accidents highlight the dangerous conditions that construction workers face in Texas. On the job injury rates are much higher on construction sites than on any other job. There is a higher risk of injury due to the nature of the work involved. In some injury cases involving construction accidents, the construction worker may only be able to collect workers’ compensation benefits. However, if the construction company employing the construction worker is not a worker’s compensation provider, the employee is entitled to file suit against the employer to redress the damages resulting from his injuries. In such case, the following issues are frequently raised to support a claim for damages against the construction company:
- Improperly or inadequately training the construction workers;
- Requiring the construction workers to use defective products or equipment;
- Requiring the construction workers to use poorly maintained products or equipment;
- Negligently using cranes or other heavy equipment;
- Injuries from falling objects;
- Falls from scaffolding or ladders;
- Burns; or
- Illnesses or physical injuries due to exposure to chemical or other hazardous materials.
