Unpaid overtime suit filed against oilfield equipment rental company

A collective action lawsuit for unpaid overtime has been filed by several current or former employees of Rig Power, Inc. and its parent company M3P Energy, LLC in federal court in Midland, Texas.  Defendant Rig Power provides rental equipment and personnel for companies in the oil and gas industry.  According to its website, Rig Power has field offices in Midland, Texas; Weatherford, Texas; San Angelo, Texas; Enid, Oklahoma; Fort Stockton, Texas; Marshall, Texas; Hobbs, New Mexico; Wysox, Pennsylvania; and Dover, Ohio.

According to the complaint filed against Rig Power in federal court, Field Technicians at Rig Power are paid a salary and receive a “daily bonus” for each day they work more than eight hours per day.  This “daily bonus” would be the same for each day that the Field Technician worked more than eight hours, regardless of the number of overtime hours that the employee worked during that week.  Thus, according to the unpaid overtime lawsuit, these Field Technicians were not compensated at a rate of one-and-a-half times their regular rate of pay for each hour worked above forty in a given week.

The plaintiffs seek to have their case proceed as a collective action lawsuit so that any employee who works or worked for Rig Power as an Field Technician within the past three years may join the lawsuit and seek overtime pay and liquidated damages. In order to participate in the lawsuit, current or former Field Technicians at Rig Power during the last three years must sign a Consent Form.
