Delivery Drivers May Be Owed Overtime Wages
If you’re a delivery driver working for an Amazon Delivery Service Partner (DSP), you may be working long hours without the overtime pay you’re legally entitled to.
A recent settlement in the case of Coleman v. Amazon.com, Inc., Et Al shows that delivery drivers can fight back—and win.
What Was the Case About?
In this case, delivery drivers in Memphis, Tennessee worked for JARS, a last-mile delivery contractor for Amazon. These drivers claimed they:
-
Regularly worked over 40 hours per week
-
Were paid a day rate of $150/day, and were not paid time-and-a-half for their overtime hours
-
Were often subject to Amazon’s policies and route delivery systems, even though they were paid by JARS
The court approved a settlement of the claims brought under the Fair Labor Standards Act (FLSA).
This case is one of several lawsuits nationwide that have challenged how Amazon and its DSPs treat and pay last-mile delivery drivers.
Common Overtime Violations – Last-Mile Delivery Drivers
Drivers working for Amazon DSPs may experience a range of illegal pay practices, including:
-
No overtime pay, even when clearly working more than 40 hours
-
Being misclassified as independent contractors
-
Being paid a day rate or flat salary with no hourly breakdown
Even though DSPs are separate companies from Amazon, the tech giant often controls the delivery schedules, tracking systems, and performance metrics—raising serious legal questions about joint employment.
Delivery Drivers May Be Owed Back Pay
Under the FLSA, you are likely entitled to:
-
Time-and-a-half for every hour over 40 per week
-
Double damages in most cases
-
Back pay for up to 3 years
-
Reimbursement of legal fees and costs
